Refer a Friend Terms and Conditions
These terms and conditions should be viewed with Ogi’s Standard Terms and Conditions.
Your use of the Service is governed by these Terms and Conditions as well as our General Terms and Conditions: Ogi Home Services and our Acceptable Usage Policy.
These terms and conditions outline the rules and guidelines governing your participation in the Ogi Refer a Friend scheme managed by Buyapowa Limited. The scheme is designed to reward you for inviting friends to experience Ogi’s exceptional offerings.
By participating in this scheme, you agree to adhere to the terms set forth herein which detail the eligibility criteria, referral process, rewards system and all other aspects of the promotion.
Our goal is to ensure a transparent and enjoyable experience for all participants promoting a sense of community while allowing you to benefit from sharing our services with friends and family.
We encourage you to read these terms carefully to ensure that you fully understand your rights and responsibilities within the scheme.
1. Definitions
Definitions
Acceptable Use Policy or AUP: This refers to Ogi acceptable use policy, relating to the use of Services as modified from time to time.
Agreement: This term encompasses these Terms and Conditions, our General Terms and Conditions, the Acceptable Use Policy, and the Ogi Privacy Policy when taken together, which in the case of conflict rank in the order of precedence listed above.
Buyapowa Limited: This is a third-party platform that help brands create campaigns to enable customers to refer friends to exclusive offers through referral programs and who Ogi will be partnering with to operate this scheme.
Contract Term: This is the minimum period of service specified in the Order Form, starting from the Operational Service Date.
Equipment: This includes any hardware listed on the Order Form or installed at a customer’s location by Ogi for the purpose of delivering the Services.
Ogi: This term refers to:
- Spectrum Fibre Limited T/A Ogi, registered in England & Wales with company number 12883320, located at Hodge House, 114-116 St. Mary Street, Cardiff, CF10 1DY. VAT Reg 377 9433 45.
Ogi Privacy Policy: Refers to Ogi’s privacy policy
The Contract Term definition refers to the Operational Service Date and Order From neither of which are defined.
Operational Service Date: The date when a Service is first made available for use by the Customer.
Order Form: Refers to the form supplied by Ogi of the Services completed by, or in accordance with an order from completed by the customer.
Satisfaction Period: This refers to the period of 30 days immediately after activation of the Friend’s Ogi Account.
Service: This refers to the services provided by Ogi, as defined in the Order Form.
Us or We: These terms refer to Ogi, and references to ‘our’ should be interpreted accordingly.
You: This term refers to the Potential Customer or Trialist, and references to ‘your’ should be interpreted accordingly.
Promotion: This refers to the Ogi Refer a Friend promotion, which is being organised by Ogi, with its registered office at Tŷ Ogi, Hodge House, 114-116 St. Mary Street, Cardiff, CF10 1DY (the “Company”).
Please read the following terms and conditions carefully, as they govern the Promotion.
2. Details
1.Promoter
1.1 The promoter of this Refer a Friend scheme (the “Scheme”) is Ogi (Spectrum Fibre), registered in England and Wales under company number 12883320, with a registered office at Hodge House, 114-116 St Mary Street, Cardiff, CF10 1DY (“Ogi”).
2. Participation Process
2.1 Eligible individuals (refer to “Eligibility” below) may participate by registering their name and email address on Our website https://ogi.wales/refer/. Upon successful registration, the individual will become a Referrer and will receive a unique web link (“Referral Link”) to share with friends and family who are not current Ogi customers (“Friends”) and who consent to receive the link.
2.2 To benefit from this Scheme, Friends must use the Referral Link to register their details and make a Qualifying Purchase (as described below).
3. Eligibility
3.1 An individual does not need to be an Ogi customer to make a referral and receive a reward.
3.2 Ogi employees and their families are excluded from participating in this Scheme. Additionally, this Scheme does not apply if the Friend is or has previously been an Ogi customer.
4. Qualifying Purchases
4.1 A “Qualifying Purchase” is defined as the order of any of Ogi’s fixed-term residential service packages.
4.2 Purchases made through third-party sellers do not qualify.
4.3 Orders that are cancelled or disconnected during the Satisfaction Period are also not considered Qualifying Purchases.
5. Reward
5.1 Eligible participants (either as Referrers or Friends) will receive a Reward through an email noreply@reward.ogi.wales (the “Reward Email”) sent by Buyapowa Limited (“Buyapowa”).
5.2 Please refer to Buyapowa’s Terms and Conditions
5.3 The Reward Email will detail how to select and redeem the Reward. This email will be dispatched after the Friend’s Ogi account has been active for a minimum of 30 days.
5.4 Orders placed throughout the duration of the Scheme will consist of
- £40 Amazon voucher redeemable at amazon.co.uk for the Referrer
- £40 Amazon voucher redeemable at amazon.co.uk for the Friend
(“the Reward”)
5.5 Within 30 to 90 days after a Friend completes a Qualifying Purchase, both the Referrer and the Friend will receive the Reward Email containing a link to claim the Reward. This email will be sent 31 days after the Friend’s installation is complete and is subject to these Terms and Conditions. The email will be sent to the addresses used to register the Promotion.
5.6 The Reward may be subject to availability, and the Reward links may only be active for a limited period as specified in the Reward Email. It is the participant’s responsibility to claim the Reward using the link provided in the Reward Email within the time frame specified.
5.7 Participants should carefully review the terms and conditions associated with the Reward, including its expiry date, as this information will be included with the Reward. The Reward Email should be stored securely; Ogi is not obligated to replace it if lost or deleted.
5.8 Self-referrals or referrals of individuals residing at the same address are not permitted.
5.9 Referrals are limited to a maximum of 10 per calendar year per household. For additional referrals, please submit details via email referafriend@ogi.wales
5.9.1 This Scheme cannot be combined with any other offers unless expressly stated in such offers.
6. Data Privacy
6.1 Personal data provided during the promotion will be processed in accordance with Ogi’s Privacy Policy, accessible at [Privacy Policy – Ogi]. Ogi will share your name and email address with Buyapowa to facilitate the dispatch of the Reward Email.
6.2 Please refer to Buyapowa’s privacy policy to understand how your data will be processed by them during the promotion.
7. Scheme Modifications
7.1 Ogi reserves the right to modify, suspend, or terminate this Scheme and/or revise these Terms at any time without prior notice. Any changes will be published on Ogi’s website.
7.2 Rewards may be withheld if fraudulent activity is suspected. All decisions made by Ogi are final. Ogi reserves the right to refuse to apply this Scheme and/or issue a Reward to anyone who breaches these Terms or has an Ogi account in arrears.
8. Limitation of Liability
8.1 This Scheme is not sponsored, endorsed, or administered by, nor associated with, Gmail, WhatsApp, Twitter, Facebook, or any other social media service. By participating in this Scheme, you provide your information to Ogi and not to these services, and you agree to release them from any liability associated with the Scheme.
8.2 Ogi shall not be held liable for:-
8.2.1 Any processing of data conducted by Buyapowa or
8.2.2 Any breaches of Buyapowa’s terms and conditions by either the Referrer or Friend.
8.3 The Referrer and Friend acknowledge that their participation in the Buyapowa platform is subject to Buyapowa’s policies and that any issues arising from such engagement are the responsibility of the Referrer and Friend.
8.4 Ogi accepts no liability for any claims, losses, or damages resulting from the actions of Buyapowa or the compliance of the Referrer and Friend with Buyapowa’s terms.
9. Network Availability
9.1 Ogi’s services, whether under this Scheme or otherwise, are only available in areas covered by Ogi’s network.
10. Governing Law
10.1 These Terms are governed by English and Welsh law, and you agree to submit to the jurisdiction of the courts in England and Wales.
